Please read these Terms of Service ("Terms") before using SundayRec software and the sundayrec.com website ("Service"), operated by Richard Fossland ("we", "us", or "our").
By downloading, installing, or using SundayRec, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
SundayRec is audio recording software designed for churches and religious organizations. It enables automatic recording of services, in-app editing and mastering of audio content, and publishing to podcast platforms. The Service is provided as a desktop application for macOS and Windows.
2. Price
SundayRec is currently provided free of charge. There is no purchase, subscription or licence fee. We reserve the right to introduce paid features in the future, but any change will be communicated clearly and existing functionality will remain available at no cost.
3. Licence
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable licence to download and use SundayRec for your organization's purposes.
You may not:
- Redistribute, sell, or sublicense the software
- Remove or alter any proprietary notices or labels
- Use the software for any unlawful purpose
4. Intellectual property
SundayRec, its logo, and all related content are the property of Richard Fossland and protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
5. Your content
You retain full ownership of all audio recordings and content you create using SundayRec. We do not access, store, or process your recordings on our servers. See the Privacy Policy for detail on how the app handles data.
6. Third-party services
If you enable cloud backup (Google Drive, Dropbox) or podcast publishing, your use of those services is governed by the respective third party's terms. SundayRec is the tool that uploads on your behalf; the relationship with the cloud provider is yours.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. While we test extensively (the app ships with over 1000 automated tests), software is software — please verify your first few recordings before relying on SundayRec for a critical service.
8. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data or recordings, arising from your use of or inability to use the Service.
9. Changes to terms
We may update these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing law
These Terms are governed by the laws of Norway. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway.
